Generally, an actual “Visa” must be obtained to travel for an extended period of time or work in the U.S. (non immigrant visas), or for a permanent residence (immigrant visas).
However, if you travel to the U.S. for business or pleasure for up to 90 days and your country (such as Italy) is part of the Visa Waiver Program
(”VWP”), you are only required to apply for an Electronic System for Travel Authorization
”). Herein below please find some new information regarding ESTA.
Notice should be taken that the Department of Homeland Security
is increasingly intensifying controls on people who enter the U.S
. in order to prevent possible nefarious activities. That is clearly reflected in the recent request from the Federal Register that, on implementation of the Terrorist Travel Prevention Act 2015
, proposes to add to the ESTA questionnaire
a new inquiry in order to obtain travelers’ Social Media identifiers.
Collecting social media data will enhance the existing investigative process and provide DHS greater clarity and visibility to possible nefarious activity and connections by providing additional information to investigators.
Additionally, the admission to the United States is not guarantee by ESTA, but Border Officials will make a determination upon arrival.
It must be noticed that ESTA can not be extended, or renewed by visiting neighboring countries such as Canada and Mexico; or Caribbean Countries, as usually wrongly supposed by travelers, and it does not allow a Change of Nonimmigrant Status or an Adjustment of Status during the stay in the U.S. (with the collaboration of Federica Magni).
